What is triple talaq?????

It is a practice under which a muslim man can divorce his wife by simply uttering “Talaq” three times in accordance with muslim law.

As we know India is country that has a privision for personal laws for all religious communities.Hence the personal laws for muslim law in india is run by All India Muslim Personal law Board.As it is against the principle of All India Muslin personal laws so they are opposing the move to ban triple talaq and Polygamy.As per the judgement in february 2015 the supreme court of india held that polygamy is not not integral part of the muslim religion and monogamy is a reform within the power of the state article 25.

Can triple talaq be banned????

Article 25 of indian constitution grants the right of religious fundamental right.

Islamic divorce is fundamental to religion and wether it is a fundamental right or not was examined by five judge bench with 3:2 ,where three are in favour and two are in against.

Supreme court in it’s earlier instance has already stated that the practice is unconstitutional

“what is sinful under a religion can’t be valid in law”.

Five judge was constituted in which three judges declared triple talaq as unconstitutional.with remaining it to banned for 6months.As it isn’t constitunally valid and voilate of constitutional morality.

Legal provision voilation

Triple talaq be permissible practice but it retrogate and unworthy because women doesn’t since triple talaq is instant it is irrevocable and the marital get broken.It is voilation of Article 14(right to equality).

It also voilate Article 21 as it talks about protection of life and personal liberty citizen of India.

Because after triple talaq muslim women are left to their own fate without their consent. which leads to helplessness of women due to dracanian law.

As we know that in today’s time heinous offence regarding children increasing day by day.So to prevent all such type of act law has approved a proposal received from the ministry of women and child devlopment to amend the protection of children from sexual offence act,2012.

The union cabinet has approved promulgate of criminal law (amendment) ordinance to provide death penalty to rapist of girls below 12 years .The committee was headed by prime minister.The ordinance amends indian penal code,civil procedure code ,protection of children from sexual offences act and indian evidence act.The change in the law will only become permanent once it is approved by India’s Parliment ,which is currently in recess.This act includes stringent punishment for rape of girl under 12 years has been provided with minimum jail term being 20years.which may go upto life in prison or death penalty.Minimum punishment in case of rape of women has been increased from rigorous imprisonment of 7years to 10 years extendable to life imprisonment.

In case of girl under 16 years minimum punishment has been increased from 10 to 20 years extendable to life imprisonment for rest of life,which shall mean imprisonment till that prison’s natural life.

The punishment for gang rape of a girl under 16 years of age will invariably be imprisonment for rest of life of the convicts.

The limit for investigation of all cases of rape gas been prescribed,which has to be mandatory completed within 2months. six months time limit for disposal of appeal in rape case has been prescribed.It has been prescribed that there will be no provision for anticipatory bail for a person accused of rape or gang rape of a girl under 10 years.

Special forensic kits for rape case to all police station and hospital and dedicated manpower will be provided for investigation of rape case in a time bound manner.

National crime record bureau will maintain a national database and profile of sexual offenders.This data will be regularity shared with state/UTs for tracking,maintaining and investigation including verification of incedent by police.

In 2016,64,000children rape case came up before the courts under the protection of children from sexual offences(PoCSO)act,read with IPC section 376.

Moreover of the cases of rape of women and children before the police that year in over 94 percent of the cases in which offender was known to the victim.He was either a close relative or neighbour or an acquaintances.

Far from reporting the crime death penalty is going to deter tje victim from reporting sexual assault when the offender is from the family or is known to them.

This will lead to the crime being suppressed and the victim being left completly helpless without strengthening the investiagtion process or the prosecution creating an enabling enviroment both in the court and outside and improving the conviction case .

Once upon a time there was a boy from scotland named Alex arya.He had keen desire to become a scientist.So he decided to pursue his goal.later on, he found everything was going wrong,just because of his hasty nature.which makes chasmic gap between his result and tactics.

As the time passed by,he also grew up.Still the condition was same.he start pondering over it and later on, he came to the conclusion that he will meet his mentor.He meet him and shared everything whatever he had faced in past.His mentor mention his work as an omen and told him that he is going to be a great scientist in future.But it was like myth to him. Because his work always makes him to face disappointment and berated by their native.Which gave him the feeling of loneliness.So he decided to taking himself away. he took boat and moved.

During his journey his boat strucked into ferocious storm and broke down into pieces.which makes him uncoscious .Next day he found himself on an island.As he woke up he was feeling a little suffocated and bleeding from his nose,which made him surprised.which made him to think what was happening to him.He stood up and move inside the island,he observed it as land of silence.so he start slobbering with loud sound.so that someone came to his help.But no response.He found it was land of silence with small creatures…like Python.So he decided to stay there and focus on his work.His half of the day was spent in doing his work and half in collecting Deflagrated wood for stewing food.
After a long time,he saw a boat comming towards that island.As it reached there he also went there and found it was a team of scientist,who were in that boat.who came there to do research on that island.He talked to them and shared everything whatever had happened to him.A member from that group told that he came here to sort out the same problem.And they decided to include him in their team.

As soon as the work started,they explored every aspect of that problem.But they didn’t get anything.Alex was very happy to work with researcher group,as it gives him an opportunity to work with scientist. It gives himself a feeling of scientist.Now he started to work hard.finally,he got the reason behind that which nobody had got.From his observation he invented a device by using the equipment with them.As they started to use that device they got flabbergasted result.

Now………………..

This story doesn’t give us clear view of that island.what was happening their with the people who go there.what they have got there..etc?????

Life is just like just like a piece of sugar,if you have sweetness than people get aware of you wthout introducing yourself.Bt if you don’t have that than it makes you introvert type.

I too don’t belong from the same category.which makes me out to aware of myself to everyone.But by the help of some act,game or exercise….etc.we can make ourself a little bit close to alien people.I also went through an exercise.

Exercise

It was morning time when shrinee sir came to my class.I was nervous as well as excited too.After taking short view of class sir had told us to choose a partner.Without taking a view of surrounding,i saw pooja and chose her as my companion.

Later on we were given half an hour to introduce eachother.In the begining i was little bit nervous but later on i make myself conversant with her.we share everything about ourselves,which includes a lot of interesting things.

What i get from this exercise

1.Emancipate urslf from chain of hesitation

To introduce urslf or other infrnt of public might be a difficult task.when u make urslf boundless than the bridle of ur mind automatically comes under u,means u have to make urslf boundless or we should emancipate ourslf so that we can envisage our selves better way.

Ur way of talking as well as its tune states abt ur mind status.when u talk to other in polite way that makes other to think abt urself…..means ur way of talking should be magnificent………
